Terms & cancellation policy
Last updated: October 2026
These terms govern the engagement between Apex Media (the "Service Provider") and anyone who orders a service (the "Client"), including orders placed through the website or through any other channel. Placing an order or making a payment means accepting the terms set out below.
1. About the Service Provider
Apex Media, an exempt dealer (Osek Patur) registered in Israel. Phone: +972 54-551-3992. Email: apexmediamind@gmail.com.
2. Services
The Service Provider offers digital marketing services, including paid campaign management, social media management, websites and landing pages, design and branding, and AI-based video production. The exact scope of the service, the deliverables and the timelines are set out in the quote or the package the Client approved.
3. Ordering and payment
An order is confirmed once payment is made — on a payment page on the website, or after the Client approves in writing (including by WhatsApp or email). The Service Provider is an exempt dealer (Osek Patur), so no VAT is added to the prices, and the price shown is the final price. A receipt is issued for every payment, as required by law.
Payment is made on a secure payment page of the payment processor Grow (on the website or through a link sent to the Client), by bank transfer or with a payment app. For packages whose service page says so, payment by credit card in installments is possible, up to the number of installments stated there. The Service Provider does not collect or store credit card details; payments are processed by Grow under its own terms.
In the website and landing page packages, the first year of hosting is included in the price. After that, hosting is provided for a monthly fee as set out on the service page, and it can be stopped at any time with written notice. The domain is registered in the Client's name, and at the Client's request the Service Provider will help move the site to another host.
Monthly packages (such as social media management) are paid in advance, at the start of each month of service. The minimum commitment is 3 months; after that the engagement renews month to month, and either party may end it with written notice at least 14 days before the next month of service begins.
Gifts given as part of a launch offer (such as a video or an SEO package) are given as part of the package purchased, and cannot be exchanged for money or a discount.
Please note: in paid advertising services, the ad budget paid to the advertising platforms (Facebook, Instagram and the like) is separate from the management fee and not included in it, unless explicitly stated otherwise.
4. Timelines and delivery
Timelines stated on the website are in business days (Sunday–Thursday, excluding Israeli holidays), counted from when the Client provides the materials needed to start the work — and for video production, from approval of the script. Any delay in providing materials or approvals on the Client's side postpones delivery accordingly.
5. Revisions and scope of work
Each package includes the number of revision rounds set out on the relevant service page. A revision round is one consolidated list of comments. Changing the idea, script or creative direction after it has been approved, and requests beyond the scope of the package, are priced separately and carried out only with the Client's approval.
6. Cancellation and refund policy
The Client may cancel an order with written notice, as follows:
- Before work starts — cancelling before the Service Provider has started work (including writing a script, an idea or content): a full refund of the amount paid.
- After work starts, before the script or design is approved — the amount paid is refunded minus a proportional charge for the work actually done.
- After the script or design is approved, or production or development has started — no refund is given for the part already done, since it is custom work for the Client.
- Design guarantee on landing pages — a Client who isn't happy with the design direction presented may cancel the order before development starts and receive a full refund of the amount paid.
- Monthly packages — cancelling before work starts gives a full refund. A month of service that has started is not refunded. Cancelling during the commitment period means paying the remaining months until it ends; after that, the service can be stopped as set out in section 3, with no extra charge.
- Multi-video packages — the videos not yet produced can be cancelled. Videos already produced are charged at the single-video price, and the difference is deducted from the refund.
Refunds are made by the same payment method used for the transaction, within 14 business days of the cancellation being confirmed.
None of the above limits the rights of a Client who is a "consumer" as defined in Israel's Consumer Protection Law, 1981, and the regulations made under it, including the right to cancel a distance sale.
7. Cancellation by the Service Provider
The Service Provider may cancel an order and refund the full amount paid if it turns out that the service cannot be provided, or if the content of the order breaches the law, these terms or the advertising platforms' policies.
8. Intellectual property and rights of use
Once full payment is made, the Client receives the rights to commercial use of the final deliverables produced for them — including in paid ads, regular posts and on the Client's website. Raw materials, working files, assets licensed from third parties and working methods remain the property of the Service Provider.
The Client confirms that every material they provide to the Service Provider (logo, images, text, trade names) belongs to them or that they have permission to use it, and takes full responsibility for this.
The Service Provider may show the deliverables in its portfolio and marketing channels, unless the Client asks otherwise in writing.
9. AI-generated deliverables
Some deliverables are produced with artificial intelligence tools. The Client is aware of this and agrees to it. These deliverables may include characters, voices or scenes that were generated artificially and do not document real people or events.
Advertising platforms may require AI-generated content to be labelled, and their policies change from time to time. The Service Provider works according to the policy known at the time of production, but cannot guarantee that any external platform will approve any ad.
Responsibility for the content of the marketing messages, statements and promises in the deliverable — including compliance with advertising and consumer protection laws — lies with the Client, who approves the deliverable before it is published.
10. Liability and its limits
The Service Provider undertakes to provide the service professionally and with reasonable skill. However, the results of marketing campaigns depend on many factors beyond its control — including the advertising platforms' algorithms and policies, competition, seasonality and the nature of the business. There is therefore no commitment to a particular result, number of leads or volume of sales, unless explicitly agreed otherwise in writing.
The Service Provider's liability for any reason will not exceed the amount actually paid for the service in question. The Service Provider is not liable for indirect or consequential damage or loss of profits.
11. Privacy
The use of personal information is governed by the website's privacy policy.
12. Changes to the terms
The Service Provider may update these terms from time to time. The binding version is the one published on the website when the order is placed.
13. Law and jurisdiction
These terms are governed solely by the laws of the State of Israel. The competent courts in the State of Israel have exclusive jurisdiction over any dispute.
14. Contact
For any question about these terms or about cancelling a transaction, contact us by phone at +972 54-551-3992 or by email at apexmediamind@gmail.com.
This is an English translation of the terms. If there is any conflict between the English text and the Hebrew text, the Hebrew text is binding.
